1. Subject
1.1. These general terms and conditions of sale govern the purchase of products, made remotely via the internet, from the website www.biemmesport.com.

2. Acceptance of the General Terms and Conditions of Sale
2.1. All purchases of products made through the website by users who access it are governed by these general terms and conditions, as well as the Italian Consumer Code (Legislative Decree no. 206/2005) and Italian regulations on electronic commerce (Legislative Decree no. 70/2003).
2.2. By completing purchase agreements according to the procedure, the customer accepts and agrees to comply with these general terms and conditions.
2.3. Therefore, the customer must carefully read these general terms and conditions before making any purchase, which B.Evo Srl makes available to them, also to allow reproduction and storage in accordance with the provisions of Article 12, paragraph 3 of Legislative Decree 70/2003.
2.4. B.Evo Srl reserves the right to modify, at any time and without notice, the content of the general terms and conditions. Each individual purchase agreement will apply the general terms and conditions published on the site at the time the customer submits the purchase order.
3. Products
3.1. www.biemmesport.com is an online store for clothing exclusively under the Biemme brand.
3.2. All products offered are clearly illustrated within the relevant sections, divided by product categories. The products are described and illustrated as accurately as possible. We follow a policy of continuous development, seeking to improve and perfect our products as much as possible; therefore, we reserve the right to modify at any time and without notice the descriptions of the products, prices, and any other details.
3.3. The visual representation of the products on the website, where available, is for illustrative purposes and typically corresponds to the photographic image of the products themselves. Its sole purpose is to present the products for sale, without any guarantee or commitment from B.Evo Srl regarding the exact correspondence between the image displayed on the site and the actual product, especially regarding its real size and/or the color aspects of the products and/or packaging.
3.4. In case of discrepancies between the image and the written product description, the product description shall prevail.
4. Purchase Procedure
4.1. The customer can purchase the products displayed in the electronic catalog detailed on the website within the respective sections by product category.
4.2. To purchase the products, the customer must register on the website by entering their personal details, following the registration instructions, and must complete and submit to B.Evo Srl the order form in electronic format available on the website, following the instructions therein. Purchase orders must be completed in full.
4.3. The customer must add the selected products to the appropriate “Cart” and, after selecting the courier and reviewing and accepting the shipping charges, they may proceed with the purchase.
4.4. Upon completion of this operation, the customer will view a screen containing a summary of the purchase order, including shipping costs, and will be asked for final confirmation of the purchase procedure.
5. Conclusion of the Contract
5.1. The display of products on the website constitutes an invitation to customers to submit a contractual purchase proposal. The order submitted by the customer constitutes a contractual offer and implies full knowledge and acceptance of these general terms and conditions.
5.2. Each purchase contract concluded between B.Evo Srl and the customer must be considered finalized when B.Evo Srl sends an acceptance of the order to the customer's email address. This confirmation message will indicate an "Order Number," to be used in any subsequent communication with B.Evo Srl. The message will include, in addition to the information required by law, all the data entered by the customer, who undertakes to verify their accuracy and promptly notify any corrections. Any additional expenses due to unreported data errors will be borne solely by the customer.
5.3. Each order can be viewed by the customer on the website in their personal area or by contacting B.Evo Srl Customer Service.
5.4. The customer may review the contents of concluded purchase agreements at any time by accessing their personal area on the website or contacting B.Evo Srl Customer Service. This data will be available for a period of 12 months from the product delivery.
6. Product Prices
All product prices are clearly indicated on the website and include VAT. All orders are processed in Euro (€). Delivery costs are properly highlighted at the time of order placement. The cost of each shipment may vary depending on the delivery method, payment method, destination, and total order amount.
7. Invoicing and Payment Methods
7.1. B.Evo Srl issues an invoice for the purchased products when the products are handed over to the courier for shipping, sending it to the customer via email. The information provided by the customer will be used for invoicing purposes. No changes can be made to the invoice after its issuance.
7.2. Accepted payment methods: Cash on Delivery (payment to the courier), Bank Transfer, PayPal. As further detailed in the relevant sections, payments with PayPal only require authorization or reservation of funds without actual charging at the time the customer places the order. The payment will only be charged to the customer when the products are handed over to the courier for shipping. At that time, B.Evo Srl will issue the invoice for the order.
7.3. Payment for products purchased through PayPal is made as follows: PayPal, an eBay company, is a fast and secure payment system.
Once the order is completed and PayPal is selected as the payment method, the buyer will be redirected to the PayPal website, where they can log in to their account by entering their personal email and password. After registration, payments via PayPal can be made without re-entering data, even for future purchases.
By choosing to pay with PayPal, the amount is charged directly to the assigned credit card (Visa, Visa Electron, Mastercard) or prepaid card (PostePay). PayPal protects the buyer's information as no financial data is shared.
Each transaction made with this method will be confirmed by PayPal via email. The order amount is charged to the PayPal account at the time the order is processed by the courier. At the time of order placement on the website, only an authorization request is made to check the availability of funds on the customer’s PayPal account, without any charges.
In case of order cancellation, the amount will be refunded to the customer’s PayPal account.
8. Delivery Methods and Costs
8.1. B.Evo Srl commits to delivering the goods without undue delay and in any case no later than thirty days from the conclusion of the contract. Product delivery will be carried out by a courier, and the times will vary depending on the destination. The terms indicated at the time of the purchase order are for guidance purposes only.
8.2. B.Evo Srl delivers to all countries indicated on the website, and delivery will take place without an appointment.
8.3. No responsibility can be attributed to B.Evo Srl in any way for delays in processing the order or delivering the products purchased under the sales contracts.
8.4. The ordered products will be shipped to the postal address specified by the customer. When B.Evo Srl hands over the products to the courier, the customer will receive an email confirmation of the shipment.
8.5. Deliveries are made Monday to Friday, during normal office hours, excluding national holidays and company closures according to the courier's methods. Delivery is considered complete when the product is made available to the customer at the address specified in the order form. In case of failed delivery due to the recipient's absence at the specified address, the courier will send a notification email and attempt a new delivery according to their predetermined procedures.
In case of failure to deliver again due to the recipient's absence, Customer Service will attempt to contact the customer to arrange another delivery. If Customer Service is unable to contact the customer within 10 days or in case of further delivery failure due to the recipient's absence, the products will be returned to B.Evo Srl.
Thirty (30) days after the date on which the products were returned to B.Evo Srl due to delivery failure, the contract will be considered terminated, and the purchase order canceled pursuant to Article 1456 of the Italian Civil Code. B.Evo Srl will refund the amount paid by the customer, minus return shipping costs and storage fees at the courier's branch.
8.6. The contract termination and refund amount will be communicated via email. The refund will be credited to the payment method used by the customer for the purchase. If, before the expiration of thirty days, the customer requests to receive the purchased products again, B.Evo Srl will proceed with a new delivery, charging both the shipping costs and return shipping costs to B.Evo Srl, as well as storage fees.
8.7. Upon delivery of the products by the courier appointed by B.Evo Srl, the customer must carefully check that the number of items delivered matches the number indicated on the delivery note.
8.8. Any damage to the packaging and products or discrepancies in the number of items or indications must be immediately reported by the customer, who can contact B.Evo Srl via Customer Service, specifying the order related to such discrepancies.
8.9. Force majeure events, unavailability of transportation, and unforeseen or unavoidable events causing delivery delays, making delivery difficult or impossible, or significantly increasing delivery costs for B.Evo Srl, shall entitle B.Evo Srl to split, defer, or cancel, in whole or in part, the expected delivery or terminate the purchase agreement. In such cases, B.Evo Srl will promptly and adequately notify the customer via the email address provided, and the customer will be entitled to a refund of any payment already made, excluding any further claims against B.Evo Srl.
9. Legal Warranty
9.1 All products are covered by a legal warranty for defects of conformity, valid for no less than 24 (twenty-four) months, provided in the territories where the delivery took place (“Legal Warranty of Conformity for Consumer Goods”) and provided for by Title III, Chapter I of the Italian Consumer Code.
9.2 If the customer has entered into the contract as a consumer (defined as any natural person who acts on the website for purposes unrelated to any entrepreneurial or professional activity they may carry out), this warranty is valid provided that the following conditions are met:
a) The defect occurs within 24 months from the date of delivery of the products;
b) The customer formally reports the defects within a maximum of 2 months from the date the defect was recognized;
c) A complaint email is sent to Customer Service at info@b-evo.com.
9.3 Specifically, in case of non-conformity, the consumer customer is entitled to have the conformity of the products restored free of charge, either by repair or replacement, or to obtain an appropriate price reduction or the termination of the contract for the affected goods and the consequent refund.
9.4 All costs of returning defective products will be borne by the seller.
9.5 The warranty, provided for the period and territory specified above, applies to products that show a conformity defect, provided that the product is used correctly, in accordance with its intended use and as specified in the technical documentation or instructions provided. This warranty is provided exclusively to the customer, who is a consumer under the Consumer Code. In case of a conformity defect, we will restore the product’s conformity at our expense through repair/replacement or a price reduction, unless contract termination is necessary.
10. Data Processing
Customer data is processed by B.Evo Srl in accordance with the current regulations on personal data protection, as specified in the privacy policy available in the section called “Privacy Policy.”
11. Communications and Complaints
All customer communications or complaints regarding purchase agreements with B.Evo Srl must be submitted using the appropriate contact forms, which can be requested from Customer Service at info@b-evo.com.
12. Intellectual Property Rights
All trademarks (registered and unregistered), as well as any intellectual property, distinctive signs, name, image, photographs, text, graphics, and in general any other intangible assets protected by intellectual and industrial property laws and international conventions reproduced on the website remain the exclusive property of B.Evo Srl and/or its licensors. Access to the website and/or the purchase agreements with customers do not confer any rights on these assets. Any use, even partial, is prohibited without prior written authorization from B.Evo Srl, which reserves all related rights exclusively.
13. Applicable Law and Jurisdiction
13.1 These general terms and conditions, as well as any purchase agreements with customers, are governed by Italian law, with the specific exclusion of international treaties on the sale of goods, particularly the 1980 Vienna Convention.
13.2 For any dispute related to the interpretation, execution, validity, or effectiveness of these general terms and conditions and any contract with customers, the Court of Vicenza shall have exclusive jurisdiction unless one party is a "consumer" under Legislative Decree 206/2005.
